Level 50 Drops

Something that is bothering me the most is the Overwhelming essence of Battle, at level 50, in maps that contain only level 50 monsters (meaning pw maps) there seems to be roughly a 50/50 chance that you'll get Overwhelming or potent essence from monsters. On that same note, these level 50 monsters seem to also have a similar chance of dropping level 49 items. And it seems in the ocean of bones, the ghost gear has begun dropping again (not that I mind that, i think its cool actually and all gear should be ghost from this area since.... well.... everything there is dead.....) But anyway, I'm wondering if it's a problem with potent essence being available from level 40-50 whereas it should be 40-49, or if level 50 monsters actually have a chance to drop level 49 items, which is, of course, wrong.
Other issue is the disgustingly high requirement to upgrade a level 50 item even once, and the tendency for level 50 items to be significantly worse than level 45 items.
